It's called "conspiracy". Anything that aids in the furtherance of a crime. If I openly declare on this forum I want to bang the shit out of someone's hot 13y old daughter because she looks like Cheryl Tiggs & then buy GHB & book a motel room online but set no actionable plan to entice the daughter with a tasty offer of a Friendly's ice cream cone it is still in furtherance of a crime despite I haven't gone thru with it yet. It's probable cause to effect an arrest for CONSPIRACY. U conflate that with "pre-crime". Hopefully, any guy here who DOES see a 62y old dude declaring a desire to bang their 13y old grand-daughter should be concern enough to warrant action of some kind to interfere, interdict or prohibit the possibility of accomplishing the same. This is under the assumption of having the means, opportunity & likelihood of accomplishing his goals as fact. There is no crime except that of trespass ..... harming someone or their property. Horsefeathers but a very quaint political dissertation nonetheless.
"Probable cause" means that someone has actually witnessed a person committing a crime of trespass - it was not just talk, it was performed and seen by others. That's direct evidence. Indirect or circumstantial evidence of a trespass is "CSI" stuff which is not fully reliable and not to be accepted as eye-witness direct evidence would be. Without a personal eye-witness, there is NO "probable cause". It's just legal-eze mumbo-jumbo deceptive labeling. There is also unintentional trespass, like when a vehicle accident tears up someone yard or something, which will not be charged since there was no harmful intent as long as the person who caused the damage has it repaired. Ur talking nonsense here because u are ignorant of the legal elements of a conspiracy charge under American jurisprudence & going off on a tangent related to a topic I never broached. U are or were talking of political & civic freedoms. The shades of gray are self evident in a conspiracy charge as they are now applying to Trump in a similar fashion albeit for different charges/reasons. To wit:
Agreement or Understanding: Two or more individuals must have a mutual agreement or understanding to commit an offense against persons or to defraud them.
Knowing Entry: The defendant must knowingly enter into the agreement or understanding, with the intent to jointly commit a crime.
Intent to Jointly Commit a Crime: The individuals involved must have the specific intent to commit the crime, which is the object of the conspiracy.
Overt Act: An overt act must be taken in furtherance of the agreement, which demonstrates that the agreement has advanced from merely talk to action.
Unity of Purpose: The jury must find that the government proved a unity of purpose between the defendant and their alleged conspirator.
(Good luck using any "Sovereign Citizen" talking points as ur defense!)
"Pre-crime" a'la Minority Report is not a crime and cannot be lawfully prosecuted. If a person has not actually trespassed another human, there is no crime. AFTER a crime has been committed (trespass), then any conspirators in the trespass can also be prosecuted, but the commitment of a crime (trespass) must be proven. According to what you've declared above then conspiracy is a "pre-crime". Good luck with that.
You're free to think and talk about whatever you like, but if you have not harmed anyone, stolen from them or harmed anything that they own, you have committed no crime.
