Finally, a good judicial authority outcome that gives due respect to our U.S. Constitution. The party isn't over yet because the 9th Circuit Court of Appeals would be next and that circuit has historically had a different leaning.
This one is worth following because it may eventually end up at the U.S. Supreme Court.

The judge is correct. A "weapon" is defined by its use. If you assault someone with a baseball bat, it's a weapon. It won't matter what they do. The Constitution is merely common law put in place to restrict government over reach into peoples' lives. As long as a person doesn't cause harm to antoher person or their property, they are free to do as they please and own whatever they wish and can afford. It's just common sense.

I'm not arguing about an outdated 200+ year old Constitution that was formulated in a vastly different day, another age.
The judge's comparison of an AR-15 gun to a Swiss army knife is a classic example of the sort of convoluted malarkey that the US seems to be infected with.
A knife can cut your throat, or it can cut your sandwiches, or it can provide medical help. It can be a kitchen utensil, an aid to an operation, or it can be used as a weapon. Unlike a gun (of any sort) a knife's range is severely limited when used as a weapon. It's ability to inflict harm is concentrated within a range of a perp's outstretched arm, or even a few yards if thrown.
A gun has much more range, and from a single position can take in many directions in rapid succession. Especially a semi-auto.
A gun has only one prime use, to kill. It is a weapon from its outset, whether fired or not.
It sits there in the cupboard with only one potential, to disable by wounding or killing. There is no other use for it.
I suppose the judge will enjoy his enhanced holiday at Christmas this year, courtesy of the generous 'present' from the gun lobby.

If NZ had the guts when that sub-human went on his white-supremacist killing spree in Christchurch, the govt would have enacted an anti-terrorist law which includes the death penalty, made it retro-active, and shot the bastard by firing squad. That would send a message to others of his ilk that NZ is no soft touch to his sort of behaviour. It would save the tax-payer three million dollars to keep him alive for the duration of his miserable life, and I'm sure the bulk of the population here would privately feel the same. And with all the guns in America, easy access by loonies and those who have no respect for anyone else, I don't blame any decent law-abiding family man for arming himself in an effort to protect his loved ones and property. I'd do it myself if I was living over there. I'm saying that using nonsensical reasoning to justify AR-15's, especially from a judge, is plain hogwash. No wonder many people must wonder what the hell is going on when they hear rubbish like that. Unfortunately it seems to be the norm from his level, and especially from govt.

The AR-15 is so modular, and so many accessories are made for it, that it truly is the Swiss Army knife of rifles. There is also the matter of why shouldn't someone be able to own the rifle that his government would stick in his hands in order to defend it. Remember what kept the Japanese from attempting an amphibious incursion of the west coast of the U.S just after Pearl Harbor. A Japanese admiral advised that "there would be a gun behind every blade of grass".
Bottom line is that it is unfair to law abiding citizens to legislate against inanimate objects that have other useful purposes. Just enforce the laws about what people DO with them.

Fortunately during Trump’s presidency, he appointed some real judges and that Court has actually made some level headed rulings in recent years
